How SavvyKai works legally — what you agree to, how your data is handled, and what cookies we use.
These Terms of Service (“Terms”) govern your use of the SavvyKai platform, operated by VentureShock Pty Ltd (ABN 93 688 614 048) (“SavvyKai”, “we”, “us”, or “our”). By creating an account or using the platform, you agree to these Terms in full.
These Terms apply to all users of the platform, including buyers (business owners seeking services) and sellers (service providers offering packaged engagements). Some provisions apply only to buyers or only to sellers, as noted.
If you do not agree to these Terms, you must not use the platform.
You must be at least 18 years of age and have the legal authority to enter into contracts on behalf of yourself or your business. By creating an account, you confirm that you meet these requirements.
You must provide accurate, current, and complete information when creating and maintaining your account. You are responsible for keeping your account information up to date. SavvyKai may suspend or terminate accounts where information is found to be materially inaccurate.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you become aware of any unauthorised access to your account. SavvyKai is not liable for losses arising from unauthorised account access where you have failed to take reasonable security precautions.
Each business entity may operate one seller account. Individuals may maintain a buyer account and a seller account simultaneously. Creating multiple accounts to circumvent platform restrictions is a breach of these Terms.
You may use SavvyKai to browse structured service packages, submit project briefs, receive proposals, and engage service providers — all in accordance with these Terms and any applicable laws.
You must not:
SavvyKai is not a party to any agreement entered into between a buyer and a seller through the platform. We provide the structured environment in which those agreements are made, but we do not supervise, guarantee, or warranty the performance of any seller or the suitability of any engagement for a buyer's specific situation.
Sellers must complete identity verification and ABN confirmation before publishing offers. Verification confirms identity — it is not an endorsement of quality, expertise, or outcomes.
All packaged offers must accurately represent scope, price, deliverables, exclusions, and suitability criteria. Offers that misrepresent what is included will be removed. Repeated misrepresentation is grounds for account termination.
Case studies must represent real engagements. Outcomes must be accurately reported. Where outcomes are self-reported (not independently verified), this must be disclosed. Fabricated or materially inflated outcomes are a serious breach of these Terms and may result in immediate account termination.
Proposals must reflect the package scope as published. Any material variation from the published scope must be disclosed and explained in the proposal. Hidden fees introduced after enquiry are prohibited.
Project briefs must represent your genuine business situation and requirements. Deliberately misleading briefs that waste seller resources may result in account restrictions.
By submitting an enquiry, you indicate genuine interest in engaging a provider for the stated scope. You are not obligated to proceed until scope is formally agreed, but serial enquiry submission without genuine intent is a misuse of the platform.
SavvyCredits are purchased in bundles. All prices are in Australian dollars (AUD) and include GST. Credits are non-transferable and may not be on-sold or gifted to third parties.
Credits expire four years from the date of purchase. Oldest credits are consumed first. We will notify you before credits are due to expire.
Automatic refund: Where a seller submits a proposal and the buyer does not open or read it within the published refund window, the credits used to unlock that enquiry are automatically returned to the seller's balance. No request is required.
No other automatic refunds: Credits consumed for monthly listing fees or enquiry unlocks (other than as described above) are not refunded unless required by Australian Consumer Law.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law. If you have a complaint about a credit purchase, contact us at support@savvykai.com.
All platform content, design, taxonomy, and software is owned by or licensed to SavvyKai. You may not reproduce, distribute, or create derivative works from platform content without prior written consent.
By submitting content to the platform (including case studies, offer descriptions, and project briefs), you grant SavvyKai a non-exclusive, worldwide licence to display and distribute that content on the platform and in associated materials for the purpose of operating the service.
To the maximum extent permitted by law, SavvyKai's total liability to you for any claim arising from or relating to your use of the platform is limited to the total amount you paid to SavvyKai in the 12 months preceding the claim, or AUD $500, whichever is greater.
SavvyKai is not liable for: the performance of any seller; outcomes of engagements facilitated through the platform; losses arising from reliance on Kai's guidance; or any indirect, incidental, special, or consequential damages.
These limitations do not apply to liability arising from fraud, wilful misconduct, or as otherwise required by Australian Consumer Law.
You may close your account at any time through account settings. Active credit balances are forfeited on voluntary account closure except where required by law.
SavvyKai may suspend or terminate accounts without prior notice for material breach of these Terms, illegal activity, or conduct that damages the integrity of the platform. We will provide notice where reasonably practicable.
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or your use of the platform that cannot be resolved informally will be referred to mediation before legal proceedings are initiated.
